However surrogacy in India has become more complex. First of all, gay surrogacy is not allowed in India.
To be eligible for surrogacy in India one has to be married for two years and provide a marriage certificate (this means no common-law arrangements are acceptable, nor straight single parents).
You must also get a letter from your own consulate declaring that surrogacy is not illegal in your own country and that they will give your as yet unborn child or children permission to return home with you once they are born, and you must enter India with medical visa.
